{"id":1782,"date":"2019-01-04T00:00:06","date_gmt":"2019-01-04T00:00:06","guid":{"rendered":"https:\/\/fdfamilylaw.wpenginepowered.com\/?p=1782"},"modified":"2026-05-05T06:07:37","modified_gmt":"2026-05-05T06:07:37","slug":"prenuptial-agreements-and-postnuptial-agreements","status":"publish","type":"post","link":"https:\/\/fdfamilylaw.com\/prenuptial-agreements-and-postnuptial-agreements\/","title":{"rendered":"Prenuptial Agreements and Postnuptial Agreements: FAQs"},"content":{"rendered":"<h2>Prenuptial Agreements Defined<\/h2>\n<p>A prenuptial agreement, also called a premarital agreement, is a legally binding document created with the rights and responsibilities of a couple in mind.\u00a0 Prenuptial agreements are written before a couple marries, and may address a host of issues relevant to the couple.\u00a0 Postnuptial agreements are entered into after the couple marries.<\/p>\n<p>The purpose behind such agreements is to protect both parties, should the marriage fail in the future.\u00a0 Couples are more willing to consider the other person, and more likely to seek a fair settlement, when they are discussing this at the beginning of the marriage, rather than the end.\u00a0 Furthermore, a premarital agreement provides the peace of mind that comes with certainty.<\/p>\n<h2>What Do Prenuptial and Postnuptial Agreements Cover?<\/h2>\n<p><a href=\"https:\/\/law.justia.com\/codes\/maryland\/2015\/article-gfl\/title-8\/subtitle-1\/section-8-101\/\" target=\"_blank\" rel=\"noopener\">Title \u00a7 8 \u2013 101<\/a>\u00a0of Maryland\u2019s Code allows couples to enter into a legally binding contractual agreement.\u00a0 A prenuptial or postnuptial agreement addresses any or all of the following areas:<\/p>\n<ul>\n<li>Alimony;<\/li>\n<li>Support;<\/li>\n<li>Property rights; and<\/li>\n<li>Personal rights.<\/li>\n<\/ul>\n<p>Some couples wish to address alimony or spousal support in their prenuptial agreement.\u00a0 There are different types of alimony in Maryland.\u00a0 If there is no agreement as to alimony, the court decides what alimony is appropriate.\u00a0 The court also has the option of modifying an alimony agreement or an agreement for spousal support under certain circumstances.\u00a0 Thus, it is important to have an attorney experienced in drafting such agreements to protect the parties.\u00a0 Couples are also permitted to agree to no alimony, should the couple divorce.<\/p>\n<p>One common topic in agreements is the division of property couples bring to the marriage.\u00a0 Property includes grandma\u2019s heirloom diamond, recreational vehicles, a townhome, or a vacation property.\u00a0 If you or your spouse or fianc\u00e9 has a tangible item, a prenuptial agreement or postnuptial agreement is a useful tool to protect ownership.\u00a0 Rights to intellectual property, such as one party\u2019s idea for a novel, are similarly subject to an agreement. \u00a0As people marry later in life, more couples enter the marriage with retirement accounts.\u00a0 An agreement on the division of the retirement accounts of the couple is common.\u00a0 Debts are another area couples may wish to address in prenuptial agreements.<\/p>\n<p>These agreements may also address the right to control a given piece of property.\u00a0\u00a0 This includes the right to dispose of property, manage the property, mortgage the property, create a security interest in the property, encumber the property, consume the property, lease the property, exchange the property, abandon the property, use the property, or transfer the property.<\/p>\n<h2>Who Should Consider a Prenuptial Agreement?<\/h2>\n<p>While many people believe prenuptial agreements are only for the very wealthy, this is no longer the case.\u00a0 The following list details some of the people who benefit from creating a premarital agreement or a post-marital agreement:<\/p>\n<ul>\n<li>People getting married later in life;<\/li>\n<li>People with children from another relationship, who want to protect the children\u2019s inheritance;<\/li>\n<li>Those who own property;<\/li>\n<li>Those marrying someone with a significant amount of debt;<\/li>\n<li>People who received, or expect to receive, a large inheritance;<\/li>\n<li>Owners of businesses; or<\/li>\n<li>Those who have retirement accounts.<\/li>\n<\/ul>\n<h2>Can One Agree to Child Support?<\/h2>\n<p>No.\u00a0 Unlike alimony, child support is not negotiable by agreement of the adult parties.\u00a0 The court will set child support consistent with Maryland\u2019s child support laws.\u00a0 For more information on child support in Maryland, check out our blog\u00a0post\u00a0on the issue.<\/p>\n<h2>Can You Negotiate Child Custody by Agreement?<\/h2>\n<p>Children belonging to one party to the marriage remain the children of that party only, unless the other party adopts the child.\u00a0 Children of both parties are subject to the child custody laws of the state of Maryland.\u00a0 Where the court believes it is in the best interests of the child, the court \u201cmay modify any provision\u201d regarding \u201cthe care, custody, education, or support of any minor child.\u201d<\/p>\n<h2>Can a Prenuptial Agreement or Postnuptial Agreement Contract Prohibit Divorce?<\/h2>\n<p>Typically, people may engage in contracts with each other on just about any issue.\u00a0 One issue couples cannot contract, however, is the requirement to stay married \u201cuntil death do you part.\u201d\u00a0\u00a0<a href=\"https:\/\/law.justia.com\/codes\/maryland\/2015\/article-gfl\/title-8\/subtitle-1\/section-8-102\/\" target=\"_blank\" rel=\"noopener\">Maryland Code \u00a7 8 \u2013 102<\/a>\u00a0states a prenuptial agreement or post nuptial agreement \u201cis not a bar to an action for absolute or limited divorce.\u201d<\/p>\n<h2>What Are the Basic Requirements of Prenuptial or Postnuptial Agreement?<\/h2>\n<p>Agreements must be in writing.\u00a0 Both parties must sign the agreement.\u00a0 Both parties must be of sound mind at the time they enter into the agreement.\u00a0 Neither party can sign the agreement \u201cunder duress.\u201d\u00a0 Instead, couples must sign the agreement freely and voluntarily.\u00a0 Another critical requirement for a valid agreement is complete disclosure.\u00a0\u00a0 Parties must be completely honest about their assets and their debts.\u00a0 A failure to provide complete disclosure could render the agreement invalid.<\/p>\n<h2>When Does a Premarital Agreement Become Valid?<\/h2>\n<p>Premarital, or prenuptial agreements become valid after a legal ceremony takes place.\u00a0 The contract is conditioned on the marriage.\u00a0 Therefore, it is not enforceable prior to the marriage.\u00a0 Postnuptial agreements, on the other hand, are valid when both parties sign the document.<\/p>\n<h2>What If We Want to Change Our Agreement?<\/h2>\n<p>Like any contract, where the parties agree, modifications are permissible.\u00a0 If you already have a prenuptial agreement, or a postnuptial agreement, and you wish to modify the agreement, this is easily done.<\/p>\n<h2>What Should I Do If I Want a Prenuptial Agreement or Postnuptial Agreement?<\/h2>\n<p>If you and your spouse or potential spouse want to enter into a postnuptial agreement or prenuptial agreement to protect yourselves in case of divorce, contact the\u00a0<a href=\"https:\/\/law.justia.com\/codes\/maryland\/2015\/article-gfl\/title-8\/subtitle-1\/section-8-102\/\" target=\"_blank\" rel=\"noopener\">Rockville family law attorneys<\/a>\u00a0at Fait &amp;
