{"id":1801,"date":"2018-05-29T00:00:29","date_gmt":"2018-05-29T00:00:29","guid":{"rendered":"https:\/\/fdfamilylaw.wpenginepowered.com\/?p=1801"},"modified":"2023-04-26T17:03:57","modified_gmt":"2023-04-26T17:03:57","slug":"things-to-consider-when-planning-a-divorce","status":"publish","type":"post","link":"https:\/\/fdfamilylaw.com\/things-to-consider-when-planning-a-divorce\/","title":{"rendered":"Things to Consider When Planning a Divorce"},"content":{"rendered":"<p>There are multiple things to consider when planning a divorce.\u00a0 How should you approach the divorce?\u00a0 Should you keep the house?\u00a0 Does your friend really know what they are talking about when giving divorce advice?\u00a0 Below are some thoughts for your consideration.<\/p>\n<h2>Things to Consider: Approaches to Divorce<\/h2>\n<p>You and your spouse get to decide how you want the divorce to proceed.\u00a0 If you choose, you can fight over every stick of furniture and every dollar in the retirement accounts.\u00a0 However, this approach costs the most money and generally takes the largest financial toll on the parties.\u00a0 Other approaches to consider include:<\/p>\n<ul>\n<li>Collaborative divorce<\/li>\n<li>Mediation<\/li>\n<li>Attorney negotiated divorce<\/li>\n<\/ul>\n<p>All of these options require a certain amount of cooperation.\u00a0 In a collaborative divorce, the parties meet and share information.\u00a0 They involve experts who can evaluate parenting plans and financial decisions.\u00a0 Together, the parties, along with their specially trained attorneys, they come to a resolution.\u00a0 In mediation, an impartial third party helps facilitate discussions.\u00a0 When attorneys negotiate a divorce, the attorneys communicate with each other, guided by their clients\u2019 wishes and needs.\u00a0 By deciding to work together to resolve the issues, divorcing takes less time and costs less money.\u00a0 Of course, with any of these three approaches, if the negotiation doesn\u2019t lead to resolution, the parties are still free to go back to litigation.<\/p>\n<h2>Things to Consider: Keeping the House<\/h2>\n<p>Often times, at least one party to a divorce wants to keep the house.\u00a0 There are both financial and emotional considerations to keeping a home.\u00a0 Many people with children choose to stay in the house to provide the children with a certain amount of comfort and certainty during an otherwise difficult time.\u00a0 This is, of course, an important consideration.\u00a0 It is not, however, the only consideration when deciding whether or not to keep the house. It is important to carefully and honestly evaluate whether one is financially prepared to keep the house.\u00a0 In addition to the mortgage, there are other considerations including:<\/p>\n<ul>\n<li>Will there be any significant exterior repairs needed in the next few years, including the roof, the driveway, the windows, and the siding<\/li>\n<li>Will there be any significant interior repair needed in the next few years, including the furnace, water heater, or air conditioner<\/li>\n<li>How old are the appliances such as the refrigerator, washing machine, dryer, and dishwashing machine<\/li>\n<li>How much will upkeep cost, including yard maintenance and snow removal<\/li>\n<\/ul>\n<p>It is not enough to know you can pay the mortgage.\u00a0 Instead, you have to be prepared to fix anything else that goes wrong.<\/p>\n<h2>Things to Consider: Be Wary of Opinions<\/h2>\n<p>When people divorce, friends and family often want to help.\u00a0 Frequently, well-meaning friends and family offer advice on everything from property division to caring for the children to divorce strategy.\u00a0 Sifting and sorting through the flood of opinions can be exhausting.\u00a0 Generally speaking, the decision about what advice to listen to and follow and what advice to cast aside depends on what the advice is about.<\/p>\n<h2>Things to Consider: When a Friend Offers Advice about Divorce Decisions<\/h2>\n<p>Advice along the lines of \u201cYou should take everything he\u2019s got,\u201d and \u201cThere\u2019s no way you should let her have the house\u201d address the division of marital property.\u00a0 Comments such as, \u201cThey can see the kids every other weekend and Tuesday nights and that\u2019s it!\u201d go to child custody issues.\u00a0 If your friend is just venting, or commiserating in frustration, a smile and a nod is fine.\u00a0 If your friend is advocating a position, however, put this opinion to the side.
