Many times, the parties find child custody proceedings both legally complex and emotionally difficult.\u00a0 Disputes arise when the parties disagree on the best interests of the children involved.\u00a0 Frequently, each party believes that they know what is in the best interests of their children and will stand up for the resolution they believe in. \u00a0If the parties do not reach an agreed upon settlement, a court will decide what is in the best interest of the children.\u00a0 This includes primary physical custody and an appropriate parenting schedule.<\/p>\n

This process becomes even more contentious and emotional when allegations of child abuse are made.\u00a0 Maryland\u00a0law<\/a>\u00a0provides the following:<\/p>\n

(a)\u00a0\u00a0 In any custody or visitation proceeding, if the court has reasonable grounds to believe that a child has been abused or neglected by a party to the proceeding, the court shall determine whether abuse or neglect is likely to occur if custody or visitation rights are granted to the party.<\/p>\n

(b)\u00a0\u00a0 Unless the court specifically finds that there is no likelihood of further child abuse or neglect by the party, the court shall deny custody or visitation rights to that party, except that the court may approve a supervised visitation arrangement that assures the safety and the physiological, psychological, and emotional well-being of the child.<\/p>\n

What is Child Abuse?<\/h2>\n

Abuse Defined<\/h2>\n

As a preliminary matter, Maryland Family Law statute section\u00a09-101.1<\/a>\u00a0provides that abuse for this section has the meaning stated in section\u00a04-501<\/a>.<\/p>\n

Maryland Family Law statute section\u00a04-501(b)(1)<\/a>\u00a0defines \u201cabuse\u201d as any of the following:<\/p>\n

(i)\u00a0\u00a0 an act that causes serious bodily harm;<\/p>\n

(ii)\u00a0\u00a0 an act that places a person eligible for relief in fear of imminent serious bodily harm;<\/p>\n

(iii)\u00a0\u00a0 assault in any degree;<\/p>\n

(iv)\u00a0\u00a0 rape or sexual offense under \u00a7\u00a7\u00a03\u2013303<\/a>\u00a0through\u00a03\u2013308<\/a>\u00a0of the Criminal Law Article or attempted rape or sexual offense in any degree;<\/p>\n

(v)\u00a0\u00a0 false imprisonment; or<\/p>\n

(vi)\u00a0\u00a0 stalking under \u00a7\u00a03\u2013802<\/a>\u00a0of the Criminal Law Article.<\/p>\n

Child Abuse Defined<\/h2>\n

That statute goes on to provide in subsection\u00a04-501(b)(2)<\/a>\u00a0when the subject of abuse is a child, section\u00a05-701<\/a>\u00a0provides further definition of child abuse.<\/p>\n

Section\u00a05-701(b)<\/a>\u00a0provides that:<\/p>\n

(b) \u201cAbuse\u201d means:<\/p>\n

(1)\u00a0\u00a0 the physical or mental injury of a child by any parent or other person who has permanent or temporary care or custody or responsibility for supervision of a child, or by any household or family member, under circumstances that indicate that the child\u2019s health or welfare is harmed or at substantial risk of being harmed; or<\/p>\n

(2)\u00a0\u00a0 sexual abuse of a child, whether physical injuries are sustained or not.<\/p>\n

Physical abuse is nonaccidental physical injury resulting from beating, kicking, shaking, throwing, hitting or otherwise harming a child, inflicted by a parent or other caregiver. \u00a0For example, when a parent becomes angry, grabs a child by the arm and twists it, causing the arm to break, that behavior is child abuse.\u00a0 A parent mocking, yelling at, or verbally threatening a child may also be abuse. Any sexual abuse of a child is abuse under the Maryland statute.<\/p>\n

What is Child Neglect?<\/h2>\n

Maryland statute section\u00a05-701(s)<\/a>\u00a0defines child neglect as:<\/p>\n

(s) \u201cNeglect\u201d means the leaving of a child unattended or other failure to give proper care and attention to a child by any parent or other person who has permanent or temporary care or custody or responsibility for supervision of the child under circumstances that indicate:<\/p>\n

(1)\u00a0\u00a0 that the child\u2019s health or welfare is harmed or placed at substantial risk of harm; or<\/p>\n

(2)\u00a0\u00a0 mental injury to the child or a substantial risk of mental injury.<\/p>\n

Neglect is a failure of a parent or other caregiver to provide for a child\u2019s basic needs.\u00a0 A common form of neglect is abandonment.\u00a0 A child is abandoned if the location or identity of his or her parents is unknown, the child has been left alone and could suffer harm, where the parent has not maintained contact or where the parent has not provided reasonable support for the child.\u00a0 For example, a parent leaving a seven-year old child at home alone for a week while the parent disappears and takes no steps to care for the child, is neglect.<\/p>\n

What is a Mental Injury?<\/h2>\n

Maryland statute section\u00a05-701(r)<\/a>\u00a0defines a mental injury as, \u201cthe observable, identifiable, and substantial impairment of a child\u2019s mental or psychological ability to function.\u201d<\/p>\n

Sometimes, mental injury becomes apparent by the need for specific psychological, psychiatric or social work intervention.<\/p>\n

What is the Age of a \u201cChild\u201d Under Maryland Law?<\/h2>\n

Maryland Statute section\u00a05-701(e)<\/a>\u00a0defines a child as any person under the age of 18 years.<\/p>\n

What Distinguishes Physical Discipline from Physical Abuse?<\/h2>\n

Maryland statute section\u00a04-501(b)(2)<\/a>\u00a0provides, \u201c[n]othing in this subtitle shall be construed to prohibit\u00a0reasonable\u00a0punishment, including reasonable corporal punishment, in light of the age and condition of the child, from being performed by a parent or stepparent of the child.\u201d\u00a0 (emphasis added).<\/p>\n
