{"id":2143,"date":"2018-08-24T00:00:38","date_gmt":"2018-08-24T00:00:38","guid":{"rendered":"https:\/\/fdfamilylaw.wpenginepowered.com\/?p=2143"},"modified":"2023-04-26T16:56:58","modified_gmt":"2023-04-26T16:56:58","slug":"5-things-you-need-to-know-about-separation","status":"publish","type":"post","link":"https:\/\/fdfamilylaw.com\/5-things-you-need-to-know-about-separation\/","title":{"rendered":"5 Things You Need To Know About Separation"},"content":{"rendered":"<article>\n<h2>Separation and Divorce<\/h2>\n<p>In Maryland, the first legal step in the divorce process is determining what ground for divorce applies to a given case.\u00a0 (A \u201cground\u201d for divorce is a \u201clegally acceptable reason\u201d for the divorce.)\u00a0 \u201cFault\u201d grounds for divorce include:<\/p>\n<ul>\n<li>Adultery<\/li>\n<li>Cruelty of treatment<\/li>\n<li>Desertion<\/li>\n<li>Excessively vicious conduct<\/li>\n<li>Imprisonment for a crime as well as<\/li>\n<li>Insanity.<\/li>\n<\/ul>\n<p>In a \u201cno fault\u201d divorce, the parties do not point to any particular fault ground.\u00a0 Instead, they proceed in the divorce after having met certain conditions.\u00a0 For couples without minor children in common, they may obtain a no fault divorce by mutual consent without a separation period if they meet certain other requirements.<\/p>\n<h2>Separation is Not Always Required: No Fault Divorce by Mutual Consent<\/h2>\n<p>In cases where the parties do not share minor children in common, if both parties agree to the divorce, the court may grant a divorce on the ground of mutual consent.\u00a0 Parties must execute a written settlement agreement.\u00a0 This document must address all issues relating to the distribution of assets, and address any issues relating to alimony.\u00a0 Both parties must appear before the court for the hearing.\u00a0 Finally, courts only grant a no fault divorce by mutual consent where neither party files a pleading asking to set aside the settlement agreement prior to the divorce hearing.\u00a0 If all the requirements are met, the court can grant a no fault divorce by mutual consent without a waiting period.<\/p>\n<h2>Separation is Sometimes Required: Traditional No Fault Divorce<\/h2>\n<p>In cases where the couple shares minor children in common, or in cases where one party does not consent to the divorce, a couple must be separated for a period of 12 months or more before courts will grant a divorce.\u00a0 Some states, like Virginia, allow \u201cseparation under the same roof.\u201d\u00a0 This means a party may be considered legally separated even as they are living in the same house.\u00a0 In Maryland, however, that is not the case.\u00a0 Couples must reside at different residences.\u00a0 They may not live together or have sexual relations with each other.\u00a0 Doing so resets the separation date back to day one.<\/p>\n<h2>Separation Agreements Can be Useful<\/h2>\n<p>When a couple separates prior to a divorce, they often find they are facing the same issues a divorcing couple faces.\u00a0 How much child support is appropriate?\u00a0 Who will make decisions about where the child goes to school?
