Support Guidelines in Maryland"},"content":{"rendered":"<article>The state of Maryland has a statute that governs what the court must take into account when assessing the right amount of child support.\u00a0 As a general rule, Maryland presumes these guidelines are correct.\u00a0 However, there are cases when that presumption is rebuttable \u2013 but that is a post for another day.Under\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gfl&amp;section=12-204&amp;ext=html&amp;session=2017RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">Maryland Statute \u00a7 12-204<\/a>, both parents share the duty to support the children of the marriage.\u00a0 The court bases the amount of each parent\u2019s responsibility on each parents\u2019 \u201cadjusted actual incomes\u201d and the amount of custody each party has.\u00a0 Throughout the rest of this post, references to the parents\u2019 financial duties presumes this calculation.\n<h2>Child Support in General<\/h2>\n<p>The courts in Maryland rely on a standard formula for calculating child support.\u00a0 Generally speaking, courts determine child support by looking at the total income of both parents and the number of children of the marriage.\u00a0 Of course, there are times that another method will be more suitable, based on very specific facts and circumstances.<\/p>\n<h2>Additional Costs the Court Will Take Into Account<\/h2>\n<p>Courts also take into account other expenses.\u00a0 These include health insurance costs, extraordinary medical expenses, and daycare costs.\u00a0 In some cases, the court includes expenses for education and transportation in the support calculation.<\/p>\n<h3>Child Support and Health Insurance Costs<\/h3>\n<p>The court reviews the actual cost of health insurance for the children.\u00a0 The court splits the cost of health insurance amongst the parents, using the method discussed above.<\/p>\n<h3>Extraordinary Medical Expenses<\/h3>\n<p>If your child has extraordinary medical expenses, these, too are added to the basic support obligation.\u00a0 The court relies on the actual adjusted income of the parties to split responsibility.<\/p>\n<h3>Child Care Expenses<\/h3>\n<p>Child care expenses are often determined by reviewing prior child care expenses.\u00a0 Some families have not used child care in the past.\u00a0 In other cases, the court finds the current day care is not in the best interests of the child.\u00a0 In these cases, the court orders child care expenses that provide the child with day care at a licensed business or licensed home day care.<\/p>\n<h3>Private Schools<\/h3>\n<p>Where the parties agree, the court orders the cost of private school as part of child support.\u00a0 In rare circumstances, the court orders this expense as part of the parties\u2019 support obligation on the court\u2019s own decision.<\/p>\n<h3>\u00a0Transportation<\/h3>\n<p>When the parties agree, the court orders splitting the expenses of transportation between the parents\u2019 home.<\/p>\n<h2>Child Support Obligations for Very High Earners and Very Low Earners<\/h2>\n<p>Where the parents\u2019 combined income exceeds $15,000 per month, the court uses their judgement to determine the right amount of support for the child or children.<\/p>\n<p>If the combined income of the parents ranges between $100 and $1200 per month, child support ranges between $20 and $150 per month.\u00a0 The court bases the actual amount ordered on three factors.\u00a0 These factors include the parent\u2019s living expenses, the number of children, and the resources the parent has.<\/p>\n<h2>The Purpose of Child Support<\/h2>\n<p>The statute presumes the total child support received is spent directly on the child or children.\u00a0 Child support is not disposable income for the party receiving child support.\u00a0 In addition, parents cannot privately negotiate a change in the child support amount paid.\u00a0 The court makes child support determinations based on the best interests of the child.\u00a0 The state of Maryland has declared this of \u201cparamount importance.\u201d\u00a0 As such, the parties can\u2019t alter the support obligation on their own.<\/p>\n<h2>Changing the Child Support Obligation<\/h2>\n<p>Child support obligations are modifiable by order of the court.\u00a0 The court does not entertain just any request for modification, however.\u00a0 Rather, the party making the motion to modify support must show a \u201cmaterial change\u201d in circumstances.\u00a0\u00a0 The court defines a \u201cmaterial change\u201d as a change that makes a difference to the calculation of child support.\u00a0 For example, if one parent\u2019s income has changed significantly, child support modification requests are reasonable.\u00a0 Not any income change qualifies, however.\u00a0 A 25 % increase or decrease in income provides a reasonable basis for requesting a modification.\u00a0 Note, even with such a change in income, the court retains the discretion to modify the amount of support or not.<\/p>\n<p>Other circumstances reasonably lead to a request for modifications of prior orders.\u00a0 For example, if the child\u2019s needs change significantly, based on illness or disability, modification requests are reasonable.<\/p>\n<p>Furthermore, when the custodial parent\u2019s income changes significantly, modification requests are reasonable in many cases.\u00a0 Because support determinations are made by reviewing the income of both parties, a variation in either party\u2019s income qualifies.\u00a0 The same 25 % guideline applies.\u00a0 Similarly, job loss can result in a modification request, since this has a dramatic impact on combined income.<\/p>\n<h2>Incarceration<\/h2>\n<p>Finally, when a court sentences a parent to either jail or prison, this suspends child support some of the time.
