{"id":2200,"date":"2018-05-08T00:00:39","date_gmt":"2018-05-08T00:00:39","guid":{"rendered":"https:\/\/fdfamilylaw.wpenginepowered.com\/?p=2200"},"modified":"2023-04-26T17:17:40","modified_gmt":"2023-04-26T17:17:40","slug":"motions-to-modify-a-divorce-decree","status":"publish","type":"post","link":"https:\/\/fdfamilylaw.com\/motions-to-modify-a-divorce-decree\/","title":{"rendered":"Motions to Modify a Divorce Decree"},"content":{"rendered":"<article class=\"content-style\">In general, courts do not modify a divorce decree after entering a final decree.\u00a0 However, a number of exceptions to this rule exist. After a court enters a final judgment and decree, circumstances for the parties change. \u00a0Those changes occur for any number of reasons. Seeking a motion to modify a divorce decree must have a legal basis. \u00a0Simply not liking a judge\u2019s ruling or a prior agreement is not enough to modify a divorce decree.The most common motions to modify a divorce decree include motions to modify alimony, child custody, and child support. \u00a0While each motion has its own legal basis, all require a significant change in circumstances.\n<h2>Motion to Modify a Divorce Decree Regarding Alimony<\/h2>\n<p>Parties bring a motion to modify alimony when one of the parties has experienced a significant change in circumstances.\u00a0 A significant increase or decrease in income of the party paying alimony is most common.\u00a0 When, through no fault of their own, the party receiving alimony has not achieved the ability to earn an income as anticipated at the time of the original divorce decree, the receiving party may also have a basis for modification of alimony.\u00a0\u00a0When the parties agree to the terms of alimony in a divorce decree, lawyers often include language removing the court\u2019s jurisdiction to modify alimony. \u00a0In those cases, it is impossible for a court to modify the amount and duration of alimony.<\/p>\n<h2>Motion to Modify a Divorce Decree Regarding Child Custody<\/h2>\n<p>Motions to modify child custody are brought when a significant change in circumstances has occurred based on the circumstances of one or both of the parents. \u00a0Maryland courts are reluctant to modify an existing final child custody order. Note, this does not include a temporary custody order entered into during the duration of the divorce proceedings.The parent seeking modification of an existing custody order bears the burden of demonstrating to the court why it should be changed. \u00a0Courts believe stability is best for children unless something harmful exists in the child\u2019s current environment. The parent seeking a modification must show that his or her home is better than the existing environment.\u00a0 Further, the change in custody is in the best interests of the child. \u00a0It is not enough to show that the new environment would be \u201cjust as good.\u201dA child that is 16 years of age or older may bring a motion for change of custody on their own. \u00a0However, the minor must prove that the change of custody would be in his or her best interests.Of course, in some cases, both parents agree a child custody order should be modified.\u00a0 When a parent moves, changes jobs, or when the children get older, modifying the child custody order may just make good sense for the family.<\/p>\n<h2>Motion to Modify a Divorce Decree Regarding Child Support<\/h2>\n<p>Parties file motions to modify child support when a party experiences a significant change in income. \u00a0In the state of Maryland, a change of at least 25% is sufficient to justify a change in child support. A motion to modify child support in cases involving a lesser change in income are not guaranteed.The effective date of a modification of child support is the date of filing of the motion.\u00a0 Modification orders are not retroactive to the change in income. \u00a0For example, the parent paying support receives an increase in income effective January 1, but the party receiving support does not file a motion to modify child support until May 1. \u00a0The court may not order a change in support effective on the date of the income change, January 1.\u00a0 The change is effective only on the date of the filing of the motion, May 1.\u00a0 As a result, it is important to file a motion to modify child support as soon as possible.\u00a0 This is true whether seeking an increase in support received or a reduction in support paid.Note, courts will not grant a reduction in child support for the party paying child support in all circumstances where income is reduced.\u00a0 If it is found that the party voluntarily reduced his or her income for the purpose of avoiding a child support obligation.<\/p>\n<h2>Motions to Modify a Divorce Decree<\/h2>\n<p>To change the terms of a final divorce decree a party must bring a motion to modify the divorce decree. \u00a0The terms of a divorce decree most commonly modify include\u00a0alimony, child custody, and child support.\u00a0\u00a0If a party does not like the terms of the decree, that alone is not a basis for a modification.\u00a0 Instead, a significant change in circumstances is the basis for a motion to modify a divorce decree.
