{"id":2231,"date":"2018-09-12T00:00:11","date_gmt":"2018-09-12T00:00:11","guid":{"rendered":"https:\/\/fdfamilylaw.wpenginepowered.com\/?p=2231"},"modified":"2023-04-26T16:55:36","modified_gmt":"2023-04-26T16:55:36","slug":"character-witnesses-in-divorce-cases","status":"publish","type":"post","link":"https:\/\/fdfamilylaw.com\/character-witnesses-in-divorce-cases\/","title":{"rendered":"Character Witnesses in Divorce Cases"},"content":{"rendered":"<article>When people meet with a divorce attorney for the first time, they often ask about character witnesses.\u00a0 They wonder if they will need witnesses, how many, who would be best to call, et cetera.\u00a0 The good news is, most cases do not go to trial, and therefore, in most cases, character witnesses are not needed.\u00a0 However, there are some instances where character witnesses are needed.\n<h2>Understanding Character Witnesses<\/h2>\n<p>Character witnesses are, by definition, people who can testify as to the content of someone\u2019s character.\u00a0 They may testify more specifically about various topics relevant to a given case, such as:<\/p>\n<ul>\n<li>Ability to parent<\/li>\n<li>Approach to parenting<\/li>\n<li>Approach to discipline<\/li>\n<li>Dedication to the children<\/li>\n<li>Fidelity in the marriage<\/li>\n<li>Acts of physical abuse<\/li>\n<li>Community involvement<\/li>\n<li>School involvement.<\/li>\n<\/ul>\n<p>A character witness is someone who knows the party they are testifying about well enough to provide reliable information to the court.\u00a0 However, in selecting character witnesses, it is important to strike a balance.\u00a0 A sister or a best friend, for example, may have an opinion about character, however, at some point, a relationship may be considered so close the witness is biased in favor of that party.\u00a0 For this reason, it is a good idea to consider other choices for character witnesses. Depending on the issue at hand, this may include a reliable babysitter, teachers, work colleagues, or mutual family friends.<\/p>\n<h2>Understanding Character Witness Testimony<\/h2>\n<p>Character witnesses are called to testify about what they know.\u00a0 They may be asked about whether someone is a good parent, for example.\u00a0 However, the answer, a simple \u201cyes,\u201d really doesn\u2019t provide the court with a whole lot of helpful information.\u00a0 What is more helpful is an example which illustrates\u00a0why\u00a0the person is a good parent.\u00a0 For example, instead of testifying, \u201cJane is a good parent,\u201d a character witness may testify,<\/p>\n<p>Recently, Jane\u2019s 5-year-old daughter Emma had a dilemma.\u00a0 Emma came home from school in tears.\u00a0 She explained that her friends, Rudy and Dawn told her they wouldn\u2019t play with Emma if Emma played with Thomas as well.\u00a0 So, Emma explained, she thought she could play with Rudy and Dawn at school, and play with Thomas on the bus.\u00a0 But Thomas was mad at her for not playing with him at school, and wouldn\u2019t play with her on the bus.\u00a0 He was angry at her and wouldn\u2019t talk to her.<\/p>\n<p>In response, Jane took Emma onto her lap and they had a talk about how Thomas must have felt when Emma wouldn\u2019t play with him at school.\u00a0 They also talked about the fact Rudy and Dawn were not very nice to put conditions on their friendship with Emma.\u00a0 Nor was it nice to exclude Thomas from playing with them.\u00a0 Jane guided the conversation, encouraging Emma to think about how she would feel if she were Thomas.\u00a0 Together, they came up with an approach for handling the situation.\u00a0 This approach included an apology to Thomas and a plan for how to handle Rudy and Dawn.<\/p>\n<p>By providing a fact-based, actual series of events, the witness gives the court concrete information on Jane\u2019s parenting abilities.<\/p>\n<h2>Understanding How Testimony Works<\/h2>\n<p>In court, the witness is first sworn in.\u00a0 Then they are asked a series of questions by the attorney who called the witness. \u00a0After the attorney has completed their questioning, the other attorney has an opportunity to ask questions.\u00a0 The other attorney may choose to ask no questions.\u00a0 They may ask a few questions about how long the witness has known the person they are testifying for.\u00a0 They may explore the issue of bias, meaning, explore whether the character witness may have a skewed view of the person they are testifying for.\u00a0 In some cases, they may challenge the witness and the witnesses\u2019 conclusions.<\/p>\n<p>Once the witness has been subject to cross-examination, the witness may be asked more questions by the attorney who put them on the stand.\u00a0 This is referred to as re-direct examination.\u00a0 The other attorney may then choose to re-cross the witness.\u00a0 This goes on until both sides are done asking questions.\u00a0 Then the witness is excused.<\/p>\n<h2>Choosing Character Witnesses<\/h2>\n<p>Choosing which persons to call as character witnesses is a strategy decision that takes a number of factors into account.\u00a0 For example, imagine a situation involving abuse.\u00a0 A neighbor may have overheard arguments that resulted in domestic violence.\u00a0 They may have even witnessed some abuse.\u00a0 A co-worker, on the other hand, may have only witnessed a black eye or a swollen wrist.\u00a0 The witness who saw the abuse is most often a better choice than the witness who only saw evidence of abuse.<\/p>\n<p>When there are two people who could both testify to a fact or issue, there may be other considerations.\u00a0 Some people are naturally better storytellers than others.\u00a0 Witnesses that can provide information in an interesting and compelling way are often a better choice than a witness that can only deliver information in a flat, monotone voice.<\/p>\n<p>Deciding which character witnesses to call is a process that should include the client and their lawyer.\u00a0 Both individuals should discuss the matter.\u00a0 There are a number of variables to consider.\u00a0 In addition to those variables discussed above, one should consider:<\/p>\n<ul>\n<li>A person\u2019s willingness to testify. An uncooperative witness is rarely a good witness.<\/li>\n<li>Availability to testify. If a witness is scheduled to be on vacation or has other duties to attend to, this may weigh against calling them as a character witness.<\/li>\n<li>Potential for conflict.
