Alimony in Maryland is the payment by one spouse to the other. \u00a0In the state of Maryland, the purpose of alimony is to allow the receiving spouse to become self-supporting. \u00a0An alimony award is typically for a limited time allowing the spouse to attain self-sufficiency.\u00a0 Specifically, Maryland statutes, Family Law Article Title 11 governs alimony in the state of Maryland.<\/p>\n

What are the Different Types of Alimony in the State of Maryland?<\/h2>\n

The state of Maryland has three different types of alimony:<\/p>\n

Pendente Lite\u00a0alimony.\u00a0 Courts order this alimony temporarily in the early stage of a divorce proceeding.\u00a0 Further, it is only available during the pendency of the divorce. \u00a0Court\u2019s consider the reasonable financial needs of the receiving party and the other party\u2019s ability to pay. \u00a0The purpose is to maintain the status quo of the parties during the divorce proceedings.<\/p>\n

Rehabilitative alimony. \u00a0This alimony awarded for a set period of time.\u00a0 Specifically, the purpose is to provide the receiving spouse time and resources to become self-supporting.<\/p>\n

Indefinite alimony. \u00a0This alimony award is indefinite, meaning there is no limit to the duration. \u00a0Courts award indefinite alimony during a long-term marriage where only one party has worked outside the house and the other party is unable to become self-supporting. \u00a0This can be due to age or infirmity. \u00a0Indefinite alimony is also ordered where otherwise the lifestyles of the parties will be unconscionably disparate.<\/p>\n

When May a Spouse Receive Alimony in Maryland?<\/h2>\n

In the state of Maryland, either party is awarded alimony. \u00a0Maryland Family Law Article 11 section 1<\/a>.\u00a0 In some cases,\u00a0 alimony is awarded prior to the final divorce or in the Final Judgment of Divorce. \u00a0Of course, in cases of agreement by the parties, the agreements are binding. \u00a0Agreements between the parties reduced to final judgment are binding on courts and not modified.<\/p>\n

What Impact Do Grounds for Divorce Have on Alimony in Maryland?<\/h2>\n

Grounds for divorce do not automatically prevent a spouse from receiving alimony in the state of Maryland. \u00a0Maryland Family Law Article 11, section 3<\/a>.<\/p>\n

Factors Considered by the Court?<\/h2>\n

The court determines award and duration of alimony. \u00a0Maryland Family Law Article 11, section 106(a)<\/a>. \u00a0Maryland courts consider the following factors:<\/p>\n

(1) \u00a0\u00a0the ability of the party seeking alimony to be wholly or partly self-supporting;<\/p>\n

(2) \u00a0\u00a0the time necessary for the party seeking alimony to gain sufficient education or training to enable that party to find suitable employment;<\/p>\n

(3) \u00a0\u00a0the standard of living that the parties established during their marriage;<\/p>\n

(4) \u00a0\u00a0the duration of the marriage;<\/p>\n

(5) \u00a0\u00a0the contributions, monetary and nonmonetary, of each party to the well-being of the family;<\/p>\n

(6) \u00a0\u00a0the circumstances that contributed to the estrangement of the parties;<\/p>\n

(7) \u00a0\u00a0the age of each party;<\/p>\n

(8) \u00a0\u00a0the physical and mental condition of each party;<\/p>\n

(9) \u00a0\u00a0the ability of the party from whom alimony is sought to meet that party\u2019s needs while meeting the needs of the party seeking alimony;<\/p>\n

(10) \u00a0\u00a0any agreement between the parties;<\/h2>\n

(11) \u00a0\u00a0the financial needs and financial resources of each party, including:<\/p>\n

(i) \u00a0\u00a0all income and assets, including property that does not produce income;<\/p>\n

(ii) \u00a0\u00a0any award made under \u00a7\u00a7 8-205 and 8-208 of this article;<\/p>\n

(iii) \u00a0\u00a0the nature and amount of the financial obligations of each party; and<\/p>\n

(iv) \u00a0\u00a0the right of each party to receive retirement benefits; and<\/p>\n

(12) \u00a0\u00a0whether the award would cause a spouse who is a resident of a related institution as defined in \u00a7 19-301 of the Health \u2013 General Article and from whom alimony is sought to become eligible for medical assistance earlier than would otherwise occur.<\/p>\n

Other Factors?<\/h2>\n

Further, courts award indefinite alimony when the receiving spouse has a disability, illness, other infirmity or age preventing him or her from becoming self sufficient.\u00a0 In addition, courts award indefinite alimony when the respective standards of living will be \u201cunconsciously disparate\u201d after the rehabilitative process.\u00a0\u00a0Maryland Family Law Article 11, section 106(c)<\/a>.<\/p>\n

May A Court Modify an Award of Alimony in Maryland?<\/h2>\n

Unless the parties previously agreed in a final judgment that a court may not modify alimony or does not have jurisdiction to modify alimony, a court may modify duration and amount of alimony when a recipient spouse petitions the court and a \u201charsh and inequitable result\u201d occurs without an alimony extension. \u00a0Maryland Family Law Article 11, section 107(a) and (b)<\/a>.<\/p>\n

Terminating Alimony in Maryland?<\/h2>\n

Without other agreement by the parties, alimony terminates upon the death of either party, the remarriage of the receiving spouse, or a court determination that continuing alimony results in \u201ca harsh and inequitable result.\u201d \u00a0Maryland Family Law Article 11, section 108<\/a>.<\/p>\n

Who Pays Attorney Fees and Other Costs?<\/h2>\n

Courts may order either party pay reasonable and necessary expenses in a family law proceeding. \u00a0Courts consider the financial resource and needs of the party and the justification for bringing a proceeding. \u00a0Maryland Family Law Article 11, section 110<\/a>. \u00a0The court orders an amount paid directly to the lawyer.<\/p>\n

Who Pays for Medical Insurance?<\/h2>\n

Courts may order one of the parties to pay the costs of group medical insurance for the receiving party. \u00a0Maryland Family Law Article 11, section 111<\/a>.<\/p>\n

Does Mental Illness Impact Alimony in Maryland?<\/h2>\n

Maryland statute provides when two or more psychiatrists find that one of the parties is \u201cincurably insane with no hope of recovery,\u201d absent agreement of the parties, the court orders the payment of \u201calimony or support for the benefit of the insane party.\u201d \u00a0Maryland Family Law Article 11, section 112<\/a>. \u00a0This payment is a lump sum based on life expectancy, including funeral expenses or a bond to the state for payment of \u201ccare and support of the insane party\u201d including funeral expenses. \u00a0Id.<\/p>\n

What are the Tax Consequences of Alimony in Maryland?<\/h2>\n

The tax consequences of alimony are important. \u00a0In general, as of December of 2017, alimony is taxable income for the recipient. \u00a0Also, alimony is deductible from the income of the payor for tax purposes. \u00a0Maryland Tax Law Article 9, section 104<\/a>.<\/p>\n

Options for Further Enforcement<\/h2>\n

Finally, you should know courts enforce alimony orders by contempt proceedings. \u00a0Maryland Rules govern contempt proceedings. \u00a0In the appropriate circumstances, when a party fails to comply with a court order requiring or prohibiting action, courts hold the person in contempt, \u00a0Maryland Rules Article 2, section 648<\/a>.<\/p>\n
