{"id":2341,"date":"2017-05-07T00:00:58","date_gmt":"2017-05-07T00:00:58","guid":{"rendered":"https:\/\/fdfamilylaw.wpenginepowered.com\/?p=2341"},"modified":"2023-04-26T17:56:40","modified_gmt":"2023-04-26T17:56:40","slug":"pet-custody","status":"publish","type":"post","link":"https:\/\/fdfamilylaw.com\/pet-custody\/","title":{"rendered":"Divorce in the State of Maryland, Short Topic Answers \u2013 Pet Custody, Health Insurance, Child Expenses"},"content":{"rendered":"<p>Many topics on divorce in the state of Maryland require a lengthy explanation, often covering several pages.\u00a0 This collection of topics are explained quickly and with relatively short answers.\u00a0 As always, refer questions to your family law attorney and follow his or her advice.\u00a0 These issues are not simple and this post is designed to quickly provide basic answers, and are not intended to reflect legal advice in your specific case.<\/p>\n<h2>Pets<\/h2>\n<p>In some marriages, the parties view their \u201cfur babies\u201d as their children.\u00a0 The parties often become extremely attached to their pets, which causes strife during divorce proceedings.\u00a0 However, despite the parties\u2019 feelings, courts do not view pets the same as children. \u00a0The process for deciding \u201cpet custody\u201d differs dramatically from child custody determinations.<\/p>\n<p>The state of Maryland considers pets \u201cproperty.\u201d \u00a0While it may seem cold, the process of deciding where pets go mirrors determinations such as what happens to other pieces of property, like\u00a0the golf clubs or the piano.\u00a0 On the positive side, this means prenuptial or postnuptial agreements provide a vehicle for deciding pet \u201ccustody\u201d well in advance of any divorce proceeding.\u00a0 If the parties cannot agree, courts resolve the issue, just like any other property disagreement.<\/p>\n<h2>Factors For Deciding \u201cPet Custody\u201d<\/h2>\n<p>A number of factors impact the court\u2019s decision on which party gets the pets.\u00a0 Prior ownership does not necessarily determine pet custody.\u00a0 Pets may become marital property after the marriage.<\/p>\n<p>It is important to establish the primary caregiver for the pets.\u00a0 Which party brought the pets to the vet?\u00a0 Who took the pets for walks? Which party bought the food for the pets?<\/p>\n<p>Another important factor in \u201cpet custody\u201d is determining which party is better able to care for the pets.\u00a0 This can include a party that works long hours or travels often versus a party that works at home.\u00a0 Housing circumstances may also have an impact.\u00a0 Does one party have a house with a yard versus a party with a cramped apartment?\u00a0 It can also be useful to demonstrate that a party has someone the pets are familiar with to care for them when the party is unavailable.<\/p>\n<p>Child custody may also affect the award of pets.\u00a0 Courts recognize the benefits to children of being able to spend time with a beloved pet.\u00a0 Pets and the children benefit when the pets stay with the children.<\/p>\n<p>Some divorcing couples consider joint \u201cpet custody. \u00a0In this case, the parties determine the specifics of \u201ccustody,\u201d such as when each party enjoys the pet\u2019s company, and who pays for veterinary care and\/or pet insurance=.\u00a0 The attorneys incorporate this agreement in the final divorce decree.<\/p>\n<p>Maryland law takes into account pets in cases involving allegations of abuse.\u00a0 Specifically, in cases where the court finds \u201creasonable grounds to believe that the respondent has abused a person eligible for relief\u201d, an interim protective order may \u201caward temporary possession of any pet of the person eligible for relief or the respondent.\u201d\u00a0 Maryland Family Law statute section 4\u2013504.1(c)(9).<\/p>\n<h2>Health Insurance for a Spouse After a Divorce<\/h2>\n<p>Benefits for a spouse covered by the ex-spouse\u2019s employer health insurance plan terminate when the divorce finalizes.\u00a0 The ex-spouse retains the option of obtaining health insurance through the Federal COBRA plan.\u00a0 The state of Maryland also provides a continuation of coverage option through Maryland state law.<\/p>\n<p>Maryland Insurance Law statute section\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gin&amp;section=15-408&amp;ext=html&amp;session=2015RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">15-408<\/a>\u00a0details Maryland continuation of group coverage.\u00a0 Maryland state law may make group health insurance available through an ex-spouse\u2019s employer based group coverage for a longer period of time, but restrictions and requirements must be considered.<\/p>\n<p>An ex-spouse may find health insurance is cheaper or provides better coverage on the Maryland insurance market.\u00a0 This area of the law is complicated and subject to change.\u00a0 As a result, best practices include consulting with a qualified, experienced Maryland family law attorney.\u00a0 Additionally, because cost of health insurance can be significant, this cost should be considered while drafting a final divorce decree.<\/p>\n<p>Parties may also find it advantageous to delay finalization of a divorce as this also delays increased medical insurance expenses.\u00a0 This may provide the parties with additional savings temporarily, in some cases better coverage, and may be negotiated between the parties.<\/p>\n<h2>Expenses For Children After Divorce<\/h2>\n<p>Children involve significant expenses.\u00a0 During a marriage, the parties may not consider those expenses.\u00a0 However, sometimes financial situations change dramatically as a result of divorce.\u00a0 Consequently, a final divorce decree appropriately contemplates those child expenses.<\/p>\n<p>Maryland Family Law statute section\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gfl&amp;section=12-204&amp;ext=html&amp;session=2015RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">12\u2013204<\/a>\u00a0provides for child support for minor children after a divorce.\u00a0 Section\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gfl&amp;section=12-204&amp;ext=html&amp;session=2015RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">12-204(a)(1)<\/a>\u00a0provides that, \u201c[t]he basic child support obligation shall be divided between the parents in proportion to their adjusted actual incomes.\u201d\u00a0 The statute goes on to provide more detail on the child support calculations, including payments for child care.\u00a0 Maryland Family Law statute section\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gfl&amp;section=12-204&amp;ext=html&amp;session=2015RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">12-204(g)<\/a>.<\/p>\n<p>The same statute provides for payment of health insurance expenses for the children after a divorce.\u00a0 Maryland Family Law statute section\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gfl&amp;section=12-204&amp;ext=html&amp;session=2015RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">12-204(h)<\/a>.\u00a0 The statute provides \u201cthe actual cost of providing health insurance coverage for a child for whom the parents are jointly and severally responsible shall be added to the basic child support obligation and shall be divided by the parents in proportion to their adjusted actual incomes.\u201d\u00a0 Maryland Family Law statute section\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gfl&amp;section=12-204&amp;ext=html&amp;session=2015RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">12-204(h)(1)<\/a>.\u00a0 Further, \u201c[a]ny extraordinary medical expenses incurred on behalf of a child shall be added to the basic child support obligation and shall be divided between the parents in proportion to their adjusted actual incomes.\u201d\u00a0 Maryland Family Law statute section\u00a0<a href=\"https:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gfl&amp;section=12-204&amp;ext=html&amp;session=2015RS&amp;tab=subject5\" target=\"_blank\"
