{"id":2354,"date":"2019-10-14T00:00:03","date_gmt":"2019-10-14T00:00:03","guid":{"rendered":"https:\/\/fdfamilylaw.wpenginepowered.com\/?p=2354"},"modified":"2023-04-27T12:05:16","modified_gmt":"2023-04-27T12:05:16","slug":"7-of-the-worst-mistakes-you-can-make-in-your-divorce","status":"publish","type":"post","link":"https:\/\/fdfamilylaw.com\/7-of-the-worst-mistakes-you-can-make-in-your-divorce\/","title":{"rendered":"7 of the Worst Mistakes You Can Make in Your Divorce"},"content":{"rendered":"<article>\n<h2>1.\u00a0 Misusing the Internet<\/h2>\n<p>Maybe you want to tell all of his family and friends what a two-timing loser he is.\u00a0 Maybe you want to send an \u201cI\u2019ll show her\u201d email.\u00a0 Telling off your spouse, shaming them publicly, or just generally being nasty in public may feel extremely satisfying in the moment.\u00a0 However, these communications don\u2019t happen in a vacuum.\u00a0 Rather, these statements may very well be introduced into court some time in the not too distant future.\u00a0 Your spouse\u2019s lawyer may very well present those nasty grams to the court to establish it is not in your children\u2019s best interests for you to be the primary parent.\u00a0 They may argue that you are immature. \u00a0Even if there isn\u2019t an actual articulable legal basis to use your communications to win a point in a divorce, your communications can still put you in a bad light.<\/p>\n<h2>2.\u00a0 Agreeing to a Settlement with a Plan to Ask the Court to Change It<\/h2>\n<p>The best time to negotiate a settlement is during the divorce process. \u00a0One cannot simply return to court on a whim to ask for a longer period of alimony, more child support, or an adjustment to the parenting time schedule.\u00a0 Instead, unless there has been a significant change in circumstances, the divorce decree will likely stand.\u00a0 Consequently, it is important to communicate your wants and needs to your divorce attorney.\u00a0 They cannot negotiate a settlement you find favorable without knowing what is important to you.<\/p>\n<h2>3.\u00a0 Withholding Information From Your Attorney<\/h2>\n<p>The list of facts people have withheld from their divorce attorney is long.\u00a0 It can include:<\/p>\n<ul>\n<li>Extramarital affairs<\/li>\n<li>Debts<\/li>\n<li>Assets<\/li>\n<li>Domestic violence<\/li>\n<li>Mental illness, including hospitalizations<\/li>\n<li>Chemical dependency<\/li>\n<li>Children from former relationships<\/li>\n<li>Children from subsequent relationships<\/li>\n<\/ul>\n<p>Under no circumstances is it a good idea to try to hide information from your divorce attorney.\u00a0 At a minimum, it makes it more difficult to negotiate a settlement.\u00a0 However, in certain situations, withholding information is a criminal or civil violation.\u00a0 Further, dishonesty discovered during or after the divorce could threaten the finality of the negotiated settlement or ruling of the court.<\/p>\n<h2>4. Estimating Debt and Assets<\/h2>\n<p>Estimating both the value of an asset, as well as the extent of the debt, are both really bad ideas.\u00a0 Sure it takes less time.\u00a0 However, it can cost you in the long run.\u00a0 There are no shortcuts when it comes to dividing assets and debts.\u00a0 One must put in the work to make certain the data is complete and up to date.<\/p>\n<h2>5. Refusing to Pay for Experts<\/h2>\n<p>Divorce can be costly, there\u2019s no doubt about that.\u00a0 Hiring experts, of course, can add to those costs.\u00a0 In the short term, it may seem to make sense to forgo hiring those experts.\u00a0 But see number 4 above.\u00a0 Your best guestimate about the value of the family business could be off \u2013 or it could be way off.\u00a0 If you don\u2019t accurately value the business, the antiques, the art collection, etc. you can\u2019t reasonably expect a fair and just settlement.\u00a0 Similarly, financial planners and parenting experts can be worth their weight in gold.\u00a0 If your attorney tells you an expert is a good idea, believe them.\u00a0 This is not the place to cut corners.<\/p>\n<h2>6. Assigning Emotional Value to Things<\/h2>\n<p>Of course you are going to be more attached to some objects than others.\u00a0 However, when we assign emotional value to inanimate objects, we sometimes lose our ability to reason.\u00a0 Most often, this is associated with the family home.\u00a0 However, other items can also be valued emotionally more than they are worth financially.\u00a0 The problem with this approach, of course, is that one fails to appreciate the financial value, because the emotional value trumps that.\u00a0 Unfortunately, this can lead to bad financial decision making.<\/p>\n<h2>7.
